Battery energy storage systems generally have a limited footprint and do not have unique wildlife interactions. However, that does not mean that BESS developers build projects without considering the impacts.

Key Takeaways:

  • Battery energy storage systems (BESS) facilities are similar to stationary infrastructure. With a limited footprint and self-contained units, standalone BESS facilities do not pose a threat to wildlife.
  • BESS developers comply with the requirements of relevant permitting authority or authorities and typically conduct desktop site screening using geographic data layers to identify any potential sensitive resources within the proposed project area.
  • BESS facilities that are co-located with wind or solar projects are typically considered within the overall facility scope when it comes to assessment and management of potential wildlife impacts.

The Senate’s recently introduced Bipartisan American Affordability and Jobs Act of 2026 (BAAJA) represents, if passed, a major opportunity to modernize how America builds clean energy and transmission infrastructure while also accelerating significant environmental benefits.

ÁñÁ«ÊÓƵ’s latest analysis, “The Clean Energy and Environmental Case for the Bipartisan American Affordability and Jobs Act,â€ outlines how the bill’s critical provisions on permitting, environmental review, judicial review, and interconnection would address major barriers that keep viable projects from reaching operation. Clean energy stands to disproportionately benefit from these technology-neutral permitting reforms: Solar, wind and energy storage account for 93% of planned 2026 utility-scale additions and roughly 1,742 GW of projects seeking interconnection, compared with 253 GW of gas.

When clean generation or transmission is held up, higher-emitting generation operates longer and opportunities to replace it with lower-emitting resources are lost.

By creating a more predictable path to build, BAAJA can unleash:

  • Over $800 billion in new transmission and clean power infrastructure;
  • 350+ GW of new clean energy;
  • Increased access to low-cost, domestic energy, helping lower consumer prices;
  • A more reliable and resilient grid; and
  • 290 million metric tons of avoided COâ‚‚ emissions annually — equivalent to the emissions of 63 million cars.

The Bipartisan American Affordability and Jobs Act of 2026 (BAAJA), introduced on Sept. 30, could deliver major permitting reforms to our grid. A modernized, more predictable permitting process can advance critical transmission, unblock clean energy projects, and provide greater regulatory certainty, driving investment, lowering energy costs, and strengthening grid reliability for communities across the country. Ìý

This fact sheet outlines how the BAAJA can unlock American clean energy potential, including by:

  • Expanding Transmission Capacity: Expanded transmission projects could enable an estimated 200 GW+ of clean energy development. Ìý
  • Removing Gridlocks: The legislation will help move forward clean energy projects, including the 100 GW+ of projects that have been blocked or delayed by permitting and regulatory barriers. Ìý
  • Increasing Transfer Capacity: New transmission capacity typically delivers ~1.4x clean energy development — connecting abundant, low-cost American wind and solar resources to the customers that need them.Ìý
  • Delivering Wins for American Communities: Unlocked projects could lower consumer prices, build a more reliable grid, and support nearly five million jobs in communities across the country. Ìý

The one-pager and detailed summary are based on the legislative text released on September 30, 2026, the Bipartisan American Affordability and Jobs Act of 2026.

The bill provides three principal protections for projects:

  • Certainty for projects that already have their federal approvals
  • Enforceable deadlines for projects still in permitting
  • Significant remedies for systematic disparate treatment of particular project types

It also makes broad changes to:

  • Federal transmission siting, planning and cost allocation
  • NEPA
  • Clean Water Act
  • Endangered Species Act
  • Historic-preservation review
  • Federal-land renewable-energy permitting

Developers brought 164 utility-scale solar, storage, and wind projects online in the second quarter, adding 17.1 GW of new capacity and pushing total clean power capacity to nearly 388 GW, enough energy to power 83 million American households.

The 2026 Q2 Clean Power Market Report showcases steady development in the solar and storage sectors, while the pipeline for wind projects has slowed due to ongoing federal pushbacks and delays.

The quarter marked the strongest second quarter and first half of a year on record for clean energy deployments, demonstrating that companies and utilities continue to recognize the value of clean energy as a fast, affordable power source, even in an unstable policy environment.

Report Highlights:

  • New Mexico led the nation in new clean power capacity additions, adding 3.6 GW to the grid from Pattern Energy’s SunZia project and ending Texas’ two-and-a-half-year streak as the top state.
  • Battery storage surpassed 50 GW of installed capacity nationwide and now stands at nearly 53 GW.
  • The clean power pipeline reached a record 205 GW, up 20 GW (11%) year-over-year.
  • Clean power procurement totaled 14.5 GW, up 23% year over year, with power purchase agreement announcements reaching an all-time first-half record.
  • Despite the sector’s strong performance, federal permitting and review delays continue to threaten future development, particularly for land-based wind projects, contributing to a 4% decline in the land-based wind pipeline.
